This Privacy Policy applies to all personal data collected and processed through the website located at https://perola.aero/ (hereinafter referred to as the “Site”).

The owner and administrator of the Site is Perola Sky Unipesol LDA (hereinafter referred to as the “Administration”).

The Site is available to individuals who visit or use its functionality, either in whole or in part (hereinafter referred to as “Users”).

By using the services of the Site, including any software and hardware solutions, products available on the Site, and any embedded algorithms (hereinafter referred to as “Site Services”), Users give their unconditional consent to this Privacy Policy and the terms for processing their personal data as outlined herein. 1.1.4. This Privacy Policy applies only to the Site and does not cover third-party websites that may be linked from the Site unless otherwise explicitly stated.

2. PURPOSES OF PROCESSING PERSONAL DATA

2.1. The Site collects and processes only the personal data necessary for the provision of Site Services or the execution of agreements and contracts with the User, except where the law mandates the retention of personal data for a specified period.

3.8. The Site Administration may transfer User personal data to third parties engaged by the Administration to provide services to the User.

4. OBLIGATIONS OF THE PARTIES

4.1. The User agrees to:

4.1.1. Provide accurate and up-to-date personal data necessary for using the Site.

4.1.2. Update or correct personal data when necessary to keep it accurate.

4.2. The Site Administration agrees to:

4.2.1. Use the collected data solely for the purposes specified in this Privacy Policy.

4.2.2. Maintain the confidentiality of personal data and not disclose it without prior written consent from the User, unless otherwise specified in this Privacy Policy.

4.2.3. Take precautions to protect the confidentiality of User personal data, in accordance with industry standards.

4.2.4. Block personal data related to a User upon request from the User, their legal representative, or an authorized body for data protection during the period of verification of inaccurate data or unlawful actions.

5. LIABILITY OF THE PARTIES

5.1. The Site Administration is liable for damages suffered by the User due to unlawful use of personal data, in accordance with Portuguese law.

5.2. The Site Administration is not liable for the loss or disclosure of confidential information if:

5.2.1. The information was public domain prior to its loss or disclosure.

5.2.2. The information was received from a third party before being obtained by the Site Administration.

5.2.3. The information was disclosed with the User’s consent.

5.2.4. The information was disclosed to government authorities legally entitled to request and disclose such data.

6. DISPUTE RESOLUTION

6.1. Prior to filing a lawsuit, the User must submit a written claim to the Site Administration for voluntary dispute resolution.

6.2. The Site Administration will respond to the claim within 30 (thirty) calendar days from the date of receipt.

6.3. If no agreement is reached, the dispute will be referred to the competent court in accordance with Portuguese law.

6.4. Portuguese law governs this Privacy Policy and the relationship between the User and the Site Administration.

7. ADDITIONAL CONDITIONS

7.1. The Site Administration reserves the right to amend this Privacy Policy without the User’s consent.

7.2. The revised Privacy Policy takes effect upon posting on the Site unless otherwise specified.
